New OSHA “Walkaround” Rule Being Challenged

A new regulation from the Occupational Safety & Health Administration (OSHA) is scheduled to take effect on May 30, 2024. It has the potential to adversely impact the sign & graphics industry.

The new federal regulation allows third parties to accompany OSHA officials on “walkarounds” during facility inspections.

The walkaround rule has been around for decades, and it has always allowed employers and employees to authorize a representative (another employee) to accompany OSHA inspectors during workplace inspections.

But this update to the walkaround rule now allows third parties (i.e., non-employees) to accompany OSHA inspectors, raising serious questions about safety, confidentiality and labor issues for our industry.

OSHA’s new walkaround rule is currently being litigated in federal court, and ISA supports these efforts. We will continue to monitor these cases and provide updates to ISA members. For more information, please contact David Hickey.
