A major federal court case involving the regulations of signs has been decided.
In Thomas v. Bright*, the 6th Circuit U.S. Court of Appeals affirmed a previous ruling which struck down Tennessee law that distinguished between on-premise and off-premise signs as a content-based distinction.
As of this moment, the ruling applies only in Tennessee, but could soon apply to other states in the 6th Circuit (Ohio, Kentucky and Michigan), and if it is eventually appealed to and heard by the U.S. Supreme Court, it could become the law of the land.
